35 § Section 35
Uppkommer mellan arbetsgivare och arbetstagarorganisation, som Àr bundna av samma kollektivavtal, rÀttstvist om lön eller annan ersÀttning till medlem i organisationen, Àr arbetsgivaren skyldig att omedelbart pÄkalla förhandling i tvisten. Kan tvisten icke lösas vid förhandling, skall han vÀcka talan vid domstol. UnderlÄter arbetsgivaren att pÄkalla förhandling eller vÀcka talan, Àr han sÄvitt avser det omtvistade beloppet skyldig att utge ersÀttning enligt arbetstagarorganisationens mening, om kravet ej Àr oskÀligt. Lag (1977:532). In the event of a legal dispute between an employer and an employees' organisation that are bound by the same collective bargaining agreement concerning pay or other remuneration for a member of such organisation, the employer shall be obligated to immediately call for negotiations concerning the dispute. If the dispute cannot be settled by negotiations, the employer shall institute judicial proceedings. An employer who fails to call for negotiations or to institute proceedings shall be required to pay compensation in respect of the disputed amount as demanded by the employees' organisation, provided such demand is not unreasonable.
